Maria Bamieh doesn’t give up: EULEX sent all Serbian crimes cases to be tried in Serbia

Former EULEX prosecutor, Maria Bamieh, says for the RTK (Radio Television of Kosovo) that her statement given on how EULEX sent all Serbian war crimes cases in Kosovo to be investigated and tried in Serbia is correct.

“I was asked about the statement I made earlier in an RTK show, when I indicated that EULEX sent all cases of Serbian war crimes to be investigated and tried in Serbia. And that’s correct. I don’t know the numbers and the names of the cases, but I do know that all the cases dealing with Serbian citizens suspects were sent to Serbia. The reasoning given for this was that the suspects were in Serbia, and that Serbia will not extradite them, thus the only way for these cases to be investigated was to return them to Serbia for investigation. I don’t think that was necessarily correct,” she told the RTK.

“It was possible to seek alternative ways for handling these cases in a neutral jurisdiction; and to get sort of co-operation from Serbia, in order to allow suspects to be tried for the crimes they committed.”

Moreover, according to her, it’s not just these cases that were never investigated.

“I have recently learned that a number of cases involving Serbian victims have been reviewed by EULEX Human Rights College and that this body told EULEX to investigate those cases. None of those cases have been investigated. This seems to be gross negligence of duty. It is fundamentally wrong; it’s contrary to every principle of natural justice. All victims are entitled to a fair trial. The Kosovo people as well have the right to expect that EULEX will ensure fair trials, without any political interference. This just didn’t happen,” she added.

Otherwise, EULEX mission prosecutor Maria Bamieh has raised accusations towards her colleagues for taking bribes, which ate the end cost her with dismissal.
